Terms of Service

Effective Date: October 8, 2026

These Terms of Service (“Terms”) govern your access to and use of the Forge mobile application, forgeaccountability.com, and related services (collectively, the “Services”).

Forge Accountability is operated by KH ESTATES LLC, an Illinois limited liability company (“Forge,” “we,” “us,” or “our”).

Please read these Terms carefully.

By creating an account, accessing, or using the Services, you agree to these Terms and our Privacy Notice.

If you do not agree, do not use Forge.

1. About Forge

Forge is an accountability and challenge platform that allows users to:

Create challenges
Join challenges
Create commitments
Track completion
Check in
Upload proof
Build streaks
Track consistency
Participate with friends or groups
Interact with challenge participants
Compare or review progress

Features may change as the Services evolve.

2. Eligibility

You must be at least 13 years old to use Forge.

If you are below the legal age of majority where you live, you represent that you have the permission of a parent or legal guardian where required by law.

You may not use Forge if applicable law prohibits you from doing so.

3. Your Account

You may need to create an account to use some or all of Forge.

You agree to:

Provide accurate information
Maintain accurate account information
Keep your login credentials secure
Not share your credentials with unauthorized persons
Notify us if you believe your account has been compromised

You are responsible for activity occurring through your account to the extent permitted by law.

You may not:

Impersonate another person
Create an account using information you are not authorized to use
Access another person’s account without permission

4. Accountability, Fitness, and Wellness Disclaimer

Forge is designed to help users:

Establish goals
Track commitments
Participate in challenges
Build accountability
Monitor progress

Forge is not a:

Medical provider
Healthcare provider
Therapist
Dietitian
Personal trainer
Financial adviser
Legal adviser
Licensed professional service

Challenges may involve activities such as:

Exercise
Diet
Weight-related goals
Fasting
Studying
Spiritual practices
Habit changes
Personal development

You are responsible for determining whether a challenge or activity is safe and appropriate for you.

Do not engage in activities that are unsafe, unlawful, medically inappropriate, or beyond your capabilities.

Consult an appropriate qualified professional when necessary.

5. User Content

“User Content” means information or materials you submit through Forge, including:

Photos
Proof
Profile information
Challenge names
Challenge descriptions
Commitments
Notes
Comments
Reactions
Reflections
Other content you submit

You retain ownership of your User Content.

You represent and warrant that:

You own your User Content or have permission to submit it
Your User Content does not violate applicable law
Your User Content does not infringe another person’s rights

License to Forge

By submitting User Content, you grant KH ESTATES LLC a non-exclusive, worldwide, royalty-free license to:

Host
Store
Reproduce
Process
Transmit
Display
Technically modify

your User Content solely as reasonably necessary to operate, secure, improve, and provide the Services.

This license does not transfer ownership of your User Content to us.

The license generally ends when the applicable User Content is deleted, except where continued limited retention is reasonably necessary due to:

Technical backups
Shared records
Legal obligations
Fraud prevention
Security
De-identified information

Forge does not currently claim a right to use private proof photographs to train artificial-intelligence models.

6. Visibility of User Content

Some features of Forge are social.

Depending on your choices and the applicable feature, User Content may be visible to:

Only you
Authorized challenge members
Other audiences clearly identified by Forge

You are responsible for choosing appropriate privacy settings.

Do not upload images or information about another person unless you have the right or permission to do so.

7. Prohibited Conduct

You may not use Forge to:

Violate applicable law
Harass or threaten another person
Abuse or intimidate other users
Impersonate another person
Upload unlawful content
Upload content that infringes intellectual-property rights
Upload exploitative or abusive sexual content
Engage in illegal activity
Spam users
Attempt unauthorized account access
Circumvent security controls
Exploit software vulnerabilities
Introduce malware
Interfere with Forge’s operation
Manipulate points, streaks, leaderboards, or challenge results through unauthorized methods
Scrape or automatically extract Forge data without authorization
Reverse engineer the Services except where applicable law prohibits us from restricting such activity
Use unauthorized automated systems to access Forge
Use Forge in a way that materially harms the Services or other users

We may investigate suspected violations and take appropriate action.

8. Challenges and User Responsibility

Challenges are created or joined at the user’s discretion.

KH ESTATES LLC does not guarantee:

That a challenge is safe
That a challenge is appropriate
That a user will complete a challenge
That proof submitted by another user is accurate
That other challenge participants will behave appropriately
Any particular fitness, health, financial, academic, professional, spiritual, or personal outcome

You are responsible for your own decisions, behavior, and participation.

9. Proof and Verification

Forge may allow users to submit proof associated with commitments.

The existence of uploaded proof does not necessarily mean Forge independently verified that an activity occurred.

Forge may distinguish among different verification or proof states.

We may reject, remove, or restrict proof that:

Violates these Terms
Infringes another person’s rights
Is fraudulent
Is unlawful
Creates a safety or security concern

10. Forge Pro and Paid Features

Forge may offer paid subscriptions or premium functionality, including a product known as Forge Pro.

Paid features may include:

Additional active challenges
Expanded progress history
Deeper analytics
Advanced reminder controls
Other premium functionality

The specific features included in Forge Pro may change over time.

Material changes affecting paid users will be handled in accordance with applicable law and app-store requirements.

11. App Store Purchases

If you subscribe to Forge Pro through Apple or another application marketplace, payment is processed by that marketplace.

KH ESTATES LLC does not directly receive your complete payment-card information from Apple.

Before purchase, the applicable marketplace will display:

Pricing
Billing period
Renewal terms
Other required purchase information

Subscriptions may automatically renew unless canceled.

If you subscribe through Apple, you may manage or cancel your subscription using your Apple account subscription settings.

App-store terms may separately govern:

Billing
Refunds
Renewals
Payment processing

12. Free and Paid Access

Forge may provide different functionality to free and paid users.

For example, Forge may limit the number of active challenges a free user may own while allowing that user to participate in challenges created by others.

Feature limits and premium benefits may change over time.

We do not intend to delete existing user content solely because a paid subscription expires.

13. Feedback

If you voluntarily provide:

Suggestions
Product ideas
Feature requests
Feedback

you grant KH ESTATES LLC permission to use that feedback without an obligation to compensate you.

This does not transfer ownership of unrelated User Content.

14. Intellectual Property

KH ESTATES LLC and its licensors own the Services and the intellectual-property rights associated with Forge, excluding User Content.

This includes rights in:

Software
Branding
Logos
Designs
User interfaces
Graphics
Product features
Documentation
Original content provided by Forge

These Terms do not transfer Forge intellectual property to you.

You may use Forge only as authorized under these Terms.

15. Third-Party Services

Forge may rely on or integrate with third-party services, including:

App stores
Cloud providers
Authentication providers
Subscription providers
Analytics providers
Notification providers
Security providers

Third-party services may be governed by their own terms and privacy policies.

KH ESTATES LLC is not responsible for third-party services outside our reasonable control.

16. Moderation and Enforcement

We may investigate activity or content that appears to violate these Terms.

Depending on the circumstances, we may:

Remove content
Restrict content visibility
Restrict features
Suspend an account
Terminate an account
Prevent further access to Forge

We may take reasonable actions necessary to protect:

Our users
KH ESTATES LLC
Forge
The integrity of the Services

17. Account Termination by You

You may stop using Forge at any time.

Where available, you may request account deletion through the application.

You may also contact:

support@forgeaccountability.com

Deleting the Forge application from your device does not automatically delete your Forge account.

Deleting your Forge account also does not necessarily cancel an active App Store subscription.

Subscriptions must be canceled using the applicable marketplace’s subscription controls.

18. Suspension or Termination by Forge

We may suspend or terminate access to the Services if we reasonably believe:

You materially violated these Terms
Your activity creates a security risk
Your activity materially harms other users
Your activity is fraudulent
Your activity is unlawful
We are required to do so by law

Where reasonable and legally required, we may provide notice.

19. Changes to the Services

We may:

Modify features
Add functionality
Remove functionality
Change product limits
Discontinue features
Update the application

We do not guarantee that every feature will remain available indefinitely.

Material changes affecting paid services will be handled as required by applicable law.

20. Availability of the Services

We aim to provide reliable access to Forge but do not guarantee uninterrupted operation.

The Services may occasionally be unavailable because of:

Maintenance
Software problems
Network outages
Service-provider failures
Security incidents
Events beyond our reasonable control

21. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

KH ESTATES LLC DISCLAIMS WARRANTIES NOT EXPRESSLY REQUIRED BY APPLICABLE LAW, INCLUDING IMPLIED WARRANTIES OF:

MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY
RELIABILITY
AVAILABILITY

WE DO NOT GUARANTEE THAT:

THE SERVICES WILL ALWAYS OPERATE WITHOUT INTERRUPTION
THE SERVICES WILL ALWAYS BE ERROR-FREE
PROGRESS CALCULATIONS WILL ALWAYS BE PERFECT
USER-PROVIDED INFORMATION WILL ALWAYS BE ACCURATE
USER-PROVIDED PROOF WILL ALWAYS BE AUTHENTIC
USING FORGE WILL PRODUCE ANY PARTICULAR RESULT

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

22. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KH ESTATES LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

This may include loss of:

Data
Revenue
Profits
Business opportunity
Reputation

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF KH ESTATES LLC ARISING FROM OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF:

(A) THE AMOUNT YOU PAID TO KH ESTATES LLC FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR

(B) $100 USD.

Some jurisdictions do not permit certain liability limitations, so some or all of these limitations may not apply to you.

23. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless KH ESTATES LLC and its members, officers, employees, contractors, and affiliates from claims, losses, liabilities, and expenses arising from:

Your unlawful use of the Services
Your material violation of these Terms
Your violation of another person’s rights
User Content you submit without necessary rights or authorization

This provision does not apply where prohibited by law.

24. Copyright Complaints

If you believe material available through Forge infringes your copyright, contact:

support@forgeaccountability.com

A copyright complaint should identify:

The copyrighted work
The allegedly infringing material
Your contact information
A statement that you have a good-faith belief the use is unauthorized
A statement that the information provided is accurate
Your physical or electronic signature

25. Governing Law

Unless applicable law requires otherwise, these Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles.

This provision does not deprive consumers of mandatory rights available under the laws of their jurisdiction.

26. Disputes

These Terms do not currently require mandatory arbitration.

Unless KH ESTATES LLC later adopts a separately disclosed and legally reviewed dispute-resolution agreement, disputes may be brought before a court having appropriate jurisdiction.

Nothing in this section limits a consumer’s rights that cannot lawfully be waived.

27. Severability

If any provision of these Terms is determined to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
